TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SWISS CHALET, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
IN NO EVENT SHALL THE AGGREGATE LIABILITY OF SWISS CHALET EXCEED THE GREATER OF ONE HUNDRED CANADIAN DOLLARS ($100) OR THE AMOUNT YOU PAID SWISS CHALET IN THE PAST SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM.
You agree to defend, indemnify, and hold harmless Swiss Chalet, its affiliates, officers, directors, employees, agents, suppliers, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Any dispute arising out of or relating to these Terms or our Services shall be subject to the exclusive jurisdiction of the courts located within the Province of Ontario, Canada.
These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference herein, constitute the entire agreement between you and Swiss Chalet concerning your use of the Services.
The failure of Swiss Chalet to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
You may not assign or transfer these Terms, by operation of law or otherwise, without the prior written consent of Swiss Chalet. Any attempt by you to assign or transfer these Terms without such consent will be null and void. Swiss Chalet may freely assign or transfer these Terms without restriction.
Swiss Chalet shall not be liable for any failure to perform its obligations under these Terms where such failure results from any cause beyond Swiss Chalet's reasonable control, including, but not limited to, mechanical, electronic, or communications failure or degradation, strikes, lockouts, or other industrial disputes, civil unrest, riot, invasion, terrorism, war, fire, explosion, storm, flood, earthquake, pandemic, epidemic, or other natural disaster.
